1. Organization of the Inter-sectoral Management Council of the fund for prevention of tobacco harms in Vietnam

The Inter-sectoral Management Council of the fund for prevention of tobacco harms in Vietnam includes:

- The Chairman of the Council is the Minister of Health;

- The Vice Chairman of the Council is a leader of the Ministry of Finance;

Council members:

+ Representative of leaders of the Ministry of Health - Standing member;

+ Representative of leaders of the Ministry of Education and Training;

+ Representative of leaders of the Ministry of Industry and Trade;

+ Representative of leaders of the Ministry of Information and Communications;

+ Representative of leaders of the Ministry of Culture, Sports, and Tourism;

+ Representative of leaders of the Vietnam General Confederation of Labor;

Fund Director.

2. Working regime of the Inter-sectoral Management Council of the fund for prevention of tobacco harms in Vietnam

- The Council works on a collective basis, meeting every six months to consider and decide on issues within its competence and responsibility.

When necessary, the Council may hold an extraordinary meeting at the request of a member of the Council or the Director of the Fund.

- The Chairman of the Council convenes and presides over the meetings of the Council. In case of absence, the Chairman of the Council authorizes the Vice Chairman of the Council to convene and chair the meeting.

The written notice of meeting invitation must be sent to the members of the Council and related parties at least 03 (three) working days before the date of the meeting of the Council and must specify the meeting time, venue, meeting agenda, and issues to be discussed, together with relevant documents.

- Meetings of the Council are considered valid when at least 2/3 of the members of the Council are present. Council members must not be absent for more than 02 (two) consecutive meetings. The meetings of the Council are recorded in minutes, signed by the chairperson of the meeting, and stamped. Minutes of meetings of the Council are the basis for promulgating resolutions, decisions, and other documents of the Council.

- Resolutions and decisions of the Council must be approved by more than 50% of the total number of Council members. For members who are absent from the meeting of the Council, they will be sent votes to vote on the resolutions and decisions of the Council. In the case of an equal number of votes, the final decision belongs to the side with the opinion of the Chairman of the Council or the person authorized to preside over the meeting.

- The Council may invite representatives of relevant agencies and organizations to attend meetings of the Council when necessary. Representatives of these agencies and organizations have the right to speak but not to vote and are responsible for keeping the meeting information confidential in accordance with the Fund's regulations and the law.

- Resolutions of the Council are binding on the Fund and assign the Fund's Director to guide and organize the implementation.

- Members of the Council are responsible for protecting the confidentiality of information in accordance with the Fund's regulations and the law, even when they have resigned from their positions or transferred to another agency.

- The Council's operating expenses and allowances for its members shall be accounted for in the Fund's operating expenses. The Fund Office is responsible for assisting the Council.

3. Tasks and powers of the Inter-sectoral Management Council of the fund for prevention of tobacco harms in Vietnam in Vietnam

- Approve the development strategy, priority areas, criteria for selecting activities to be funded in each period and other relevant documents.

- Approve the annual operation plan and budget allocation of the Fund.

- Give opinions on the operation regulations of the Advisory Board and the Supervisory Board before promulgation by the Chairman of the Board; approve the operation plan of the Supervisory Board.

- Approve the report of the Supervisory Board on the results of inspection and supervision of the Fund's activities.

- Approve operational reports, financial statements, financial revenue and expenditure plans, and the annual financial settlement of the Fund.

- Review and propose amendments and supplements to the Fund Charter when necessary.

- Use the Fund's management apparatus and seal in performing its duties and powers in accordance with this Charter.

- The members of the Fund Management Council operate under the part-time regime and enjoy the regime according to the current regulations of the State.

- Exercise other rights and obligations as prescribed by law.
