Recently, the Government of Vietnam issued Decree No. 45/2019/NĐ-CP on penalties for administrative violations in tourism.
According to Decree No. 45/2019/NĐ-CP of Vietnam’s Government, the power of the President of People’s Committee in handling administrative violations in tourism is prescribed as follows:
The President of People’s Committee of commune has power to:
- Issue warnings;
- Impose fines of up to VND 5,000,000;
- Confiscate exhibits of administrative violations, the value of which must not exceed VND 5,000,000.
The President of People’s Committee of district has power to:
- Issue warnings;
- Impose fines of up to VND 25,000,000;
- Suspend license for tour operator business; tour guide badges; decision on recognition of tourist accommodation establishments’ ratings; decision on recognition of other tourism service business with standard tourist service; decision on recognition of tourist attractions; decision on recognition of tourist resorts for definite term or mandatorily suspend operation for definite term;
- Confiscate exhibits of administrative violations, the value of which must not exceed VND 25,000,000;
- Enforce the remedial measures.
The President of People’s Committee of province has power to:
- Issue warnings;
- Impose fines of up to VND 50,000,000;
- Suspend license for tour operator business; tour guide badges; decision on recognition of tourist accommodation establishments’ ratings; decision on recognition of other tourism service business with standard tourist service; decision on recognition of tourist attractions; decision on recognition of tourist resorts for definite term or mandatorily suspend operation for definite term;
- Confiscate exhibits of administrative violations, the value of which must not exceed VND 50,000,000;
- Enforce the remedial measures.
