Vietnam National Centre for Criminal Record has the following tasks and powers:
(1) Regarding the construction and management of the judicial record database
- Build, managing, exploiting and protecting the judicial record database nationwide;
- Guide the construction, management, exploitation and protection of judicial record databases at the Departments of Justice of the provinces and centrally-run cities (hereinafter referred to as the Department of Justice);
- Receive, update and process judicial record information provided by the Supreme People's Procuracy, competent agencies of the Ministry of Public Security, judgment enforcement agencies of the Ministry of National Defense and the Department of Justice;
- Receive criminal records provided by the Department of Justice;
- Provide criminal record information to the Department of Justice;
- Prepare judicial records, issue judicial record cards according to their competence;
- Provide judicial record information of foreigners convicted by Vietnamese courts at the request of the Supreme People's Procuracy;
(2) Perform a number of tasks in the field of judicial records assigned by the Minister, including:
- Formulate and submit to the Minister the strategy, master plan, plan, undertaking and policy in the medium and long term on judicial records;
- Elaborate schemes, projects and draft legal documents on judicial records for the Minister to promulgate or submit to competent agencies for promulgation; participate in the appraisal and comment on other projects and draft documents assigned by the Minister;
- Develop and submit to the Minister the Center's long-term, 5-year, and annual work plans; participate in the formulation of long-term, five-year and annual development strategies, planning and plans of the Justice sector;
- Develop and submit to the Minister for promulgation and guide and inspect the use of forms, papers and books on judicial records;
- Organize the implementation of strategies, master plans, plans, undertakings, policies, schemes and projects; legal documents within the scope of the Center's functions and provide professional guidance on judicial records;
- Propagate and disseminate the law on judicial records; provide professional training and retraining on judicial records as assigned and decentralized by the Ministry;
- Implement the application of information technology in building databases and managing judicial calendars according to the provisions of law and decentralization of the Ministry;
- Implement international cooperation on judicial records according to the provisions of law and decentralization of the Ministry;
- Implement the regime of statistics and reports on judicial records and the management of the judicial record database in accordance with law.
(3) Carry out inspection, participate in the inspection of the implementation of the provisions of the law on judicial records; settle complaints and denunciations according to the provisions of law and the decentralization of the Ministry;
(4) Implement the financial, accounting and management regimes and use of the Center's budget and assets in accordance with the law and the Ministry's decentralization;
(5) Perform emulation, commendation and management of the staff of the Center's civil servants, public employees and employees according to the provisions of law and the decentralization of the Ministry;
(6) Perform other duties assigned by the Minister.
