Regarding this issue, LawNet would like to answer as follows:
Specifically, in Article 8 of the Regulation promulgated together with Circular 05/2023/TT-BGDĐT, classes in gifted schools are as follows:
- Classes in gifted schools are offered according to subjects in the general education program promulgated by the Minister of Education and Training, including: Literature, History, Geography, Foreign Languages, Mathematics, Information Science, Physics, Chemistry, Biology (hereinafter referred to as gifted classes).
- Do not offer non-gifted classes in gifted schools.
- Each gifted class has no more than 35 students.
- On the basis of educational quality assurance and at the request of the principal of the gifted school, the managing authority of the gifted school shall decide the number of subjects in which gifted classes are offered (hereinafter referred to as specialized subjects) and the number of gifted classes by each specialized subject.
Thus, according to the above regulations, it is not allowed to organize non-gifted classes in gifted high schools.
Pursuant to Article 7 of the Regulation promulgated together with Circular 05/2023/TT-BGDDT, gifted schools are entitled to investment in facilities and equipment like upper-secondary schools in accordance with the regulations for national standard schools, and also in the following:
- Study rooms, study supporting rooms with sufficient quantity and standards with synchronous equipment, adequately qualified for teaching 02 (two) sessions/day.
- Modern and synchronous teaching equipment serving the teaching of gifted students and the organization of cultural, artistic and scientific research activities of teachers and students.
- Dormitories, canteens for students who are in need of boarding accommodations.
- Official houses for teachers.
- Stadiums, multi-purpose houses, swimming pools and other sports equipment and facilities.
According to Article 5 of the Regulation promulgated together with Circular 05/2023/TT-BGDDT, policy on investment in education quality assurance of the gifted schools as follows:
- Gifted schools are given priority in the following:
+ Arrange administrators, teachers and employees to meet the prescribed payroll quotas and standards;
+ Invest in building synchronous and modern material facilities and teaching equipment in accordance with law;
+ Allocate regular funding according to the provisions of law to ensure educational activities;
+ Invite teachers, lecturers, local and foreign experts to give lectures, provide professional training, and guide scientific research for administrators, teachers and students according to regulations;
+ Gifted schools affiliated to higher education institutions are allowed to use facilities, teaching equipment, laboratories, practice room and utilize lecturers of higher education institutions to teach students.
- The People's Committees of the provinces and centrally-affiliated cities (hereinafter referred to as the People's Committees of provinces) shall submit to the competent authorities for decision on additional budget funding for gifted schools under the provisions of the law on facilities, incentives for administrators, teachers and staff, and enable administrators and teachers of gifted classes specified in Clause 1, Article 8 of the Regulation promulgated together with Circular 05/2023/TT-BGDDT to attend training and retraining courses at home and abroad.
- Higher education institutions with gifted schools shall decide to supplement investment in education quality assurance for gifted schools affiliated to higher education institutions in accordance with law.
Pursuant to Article 2 of the Regulation promulgated together with Circular 05/2023/TT-BGDDT stipulating the objectives, tasks and powers of gifted high schools in Vietnam
- A gifted school is for students who achieve good results in conduct and learning in order to develop their aptitudes for a number of subjects on the basis of ensuring a comprehensive general education, creating a source of talents, meeting the development needs of the country.
- The gifted school shall perform the tasks and powers of upper-secondary schools as prescribed in the Charter of lower-secondary schools, upper-secondary schools and multi-level schools and also perform the following additional duties and powers:
+ Organize and implement the teaching plan of the advanced education program prescribed by the Minister of Education and Training;
+ Research and apply appropriately and effectively the educational program and advanced methods of management, teaching, examination and evaluation; promote the implementation of education in science, technology, engineering, art and mathematics in general education;
+ Develop administrators, teachers and employees in sufficient quantity and structure; good at expertise and profession; have scientific research capacity; use foreign languages in communication, teaching and scientific research;
+ Coordinate with relevant units in organizing professional training, retraining, foreign languages and informatics for administrators, teachers and staff to meet the objectives and tasks of the gifted school;
+ Develop cooperation activities with local and foreign education and training institutions and scientific research institutions to improve the quality of education;
+ Formulate planning and development plans and increase investment in teaching facilities and equipment in accordance with law to meet the goals and tasks of the gifted school;
+ Organize and manage student boarding activities;
+ Build, manage and effectively use the information system and database in service of the management, education and assessment of the quality and operational efficiency of the school;
+ Keep track of the learning and working process of former students;
+ In each school year, chair at least 01 (one) seminar on the organization and management of educational activities in the school with the participation of lower-secondary schools, upper-secondary schools, etc. in order to share solutions and results of performing tasks and powers of gifted schools as prescribed in Clause 2 of Article 2 of the Regulation promulgated together with Circular 05/2023/TT-BGDDT.
