Imported Scrap Left for Over 90 Days May Be Removed from Vietnam

This is a notable content mentioned in Decision 35/2019/QD-TTg promulgating the Inter-sector Coordinating Regulations on the Management of Waste Import Activities.

To be specific, according to this Regulation, for goods that are imported scrap remaining at seaports for more than 90 days and the customs authority has issued a notice for more than 60 days without anyone claiming them, the Ministry of Finance shall be responsible for handling as follows:

- Direct the customs authority to request the shipping company to transport the backlogged goods causing environmental pollution out of the territory of Vietnam.

- More than 30 days from the date the customs authority issues the notification but the shipping company does not comply then:

- The customs authority shall compile a list of shipping companies that do not comply with the recommendation for the Ministry of Transport to enforce, impose administrative sanctions, or suspend permits for entering and exiting Vietnamese seaports;

- Direct the establishment of a council to handle backlogged goods at provincial and municipal Customs Departments to conduct inventory and classify backlogged goods;
