Notable new policies of Vietnam effective from the end of April 2024

1. High school graduation exam subjects in Vietnam 2024

On March 6, 2024, the Minister of Education and Training of Vietnam promulgated Circular No. 02/2024/TT-BGDDT on amendments to the High School Graduation Exam Regulation enclosed with Circular No. 15/2020/TT-BGDDT, amended by Circular No. 05/2021/TT-BGDDT and Circular No. 06/2023/TT-BGDDT.

According to the Circular, the high school graduation exam shall have 5 papers, including: 

- 3 independent papers, which hare Mathematics, Literature, and Foreign Language (English, Russian, French, Chinese, German, Japanese, and Korean);

- 1 paper of natural science, including Physics, Chemistry, and Biology; 

- 1 paper of social science, including History, Geography, and Civic Education for students of the high school-level general education program or papers of History and Geography for students of the high school-level continuing education program.

2. 2 Decisions of Minister of Finance of Vietnam on promulgation of procedures for financial inspections to be annulled

On March 11, 2024, the Minister of Finance of Vietnam promulgated Circular No. 16/2024/TT-BTC on annulling Decisions of the Minister of Finance of Vietnam on the promulgation of procedures for financial inspections.

According to the Circular, the following 2 Decisions of the Minister of Finance of Vietnam shall be annulled:  

- Decision No. 64/2006/QD-BTC dated November 8, 2006 of the Minister of Finance of Vietnam on the promulgation of financial inspection procedures. 

- Decision No. 33/2007/QD-BTC dated May 15, 2007 of the Minister of Finance of Vietnam on the promulgation of handling procedures post financial inspections.

3. Standards of award of Advanced Laborer Titles in ethnic work in Vietnam from April 29, 2024

On March 15, 2024, the Minister, Head of the Committee for Ethnic Minority Affairs, promulgated Circular No. 01/2024/TT-UBDT on elaboration on the Law on Emulation and Commendation 2022 regarding the ethnic work sector. 

According to the Circular, the standards of the award of Advanced Laborer Titles in ethnic work are stipulated as follows: 

- Advanced Laborer Titles shall be annually awarded to individuals of units of and affiliated with the Committee for Ethnic Minority Affairs who satisfy the standards prescribed in Clause 1 Article 24 of the Law on Emulation and Commendation 2022. 

- Regarding transferred individuals, the new units shall assess them for the award of Advanced Laborer Titles. If the work period of a transferred individual at his/her old unit is at least 6 months, there must be comments from the old unit. If an individual is mobilized or seconded to another agency, organization, or unit for a specific period, the assessment for the award of Advanced Laborer Title shall be decided by the mobilizing agency, organization, or unit and confirmed by the agency, organization, or unit receiving the mobilized or seconded individual. 

- Individuals sent to short-term training or advanced training of under a year who comply with the regulations of training and advanced training programs shall have their training time included in the time of working at agencies or units for assessment for Advanced Laborer Titles. Individuals sent to training or advanced training for 1 year or more who comply with the regulations of training and advanced training facilities and have learning results assessed as good or more (regarding training and advanced training courses that have learning result classification such as average, good, excellent, etc.), shall be assessed for Advanced Laborer Titles. 

- The maternity leave time of individuals as per regulation shall be determined for the assessment for Advanced Laborer Titles. 

- Assessment for Advanced Laborer Titles shall not be carried out in one of the following cases: 

+ Individuals are newly recruited with a work period of under 6 months.

+ Individuals do not participate in working for 3 months to under 6 months in a year according to the law (except for cases of maternity leave).

+ Individuals are subject to disciplinary action assessment, investigations/inspections for having signs of violations, or complaints/denunciations undergoing verification.
