"When violating traffic, in addition to being fined, the violator will also have his driver's license revoked. So, is driving during the period of driving license suspension sanctioned in Vietnam?" - Tuyen (Ho Chi Minh City)
LawNet would like to answer your question as following:
The revocation of driving certificate (driving license) is considered as the definite deprivation of the right to use licenses, which is a form of sanction applied to individuals and organizations that seriously violate traffic activities. During the period of being deprived of the right to use the license, individuals and organizations are not allowed to carry out the activities stated in the license, namely driving (Clause 1 Article 25 of the Law on handling administrative violations 2012 of Vietnam).
Moreover, pursuant to Clause 4 Article 81 of the Decree No. 100/2019/NĐ-CP, during the suspension period, if the violator still keeps doing the activities in the license or practicing certificate, such violator shall incur a penalty for operating without a license or practicing certificate.
Thus, during the period of suspension of the driving license, the violator is not allowed to carry out the activities specified in the license, including driving. If violator still drives while the driving license is revoked, violator shall be imposed a fine according to the provisions of the Decree No. 100/2019/NĐ-CP, specifically as follows:
- Regarding motorcycles:
+ Motorcycle whose engine displacement is under 175 cm3: a fine ranging from VND 800,000 to VND 1,200,000 (Point a Clause 5 Article 21).
+ Motorcycle whose engine displacement is more than 175 cm3: a fine ranging from VND 3,000,000 to VND 4,000,000 (Point b Clause 7 Article 21).
- Regarding cars: a fine ranging from VND 4,000,000 to VND 6,000,000 (Point b Clause 8 Article 21).
