When will the Certification of Environmental Protection for Imported Scrap be revoked?

The Ministry of Natural Resources and Environment has just issued Circular 41/2015/TT-BTNMT stipulating regulations on environmental protection in the importation of scrap for use as production materials.

Circular 41/2015/TT-BTNMT stipulates three cases for the revocation of the Certificate of Environmental Protection Eligibility for imported scrap. To be specific:

- Violations of environmental protection regulations in importing scrap as production materials or regulations in the Certificate to the extent of revocation as prescribed by law;- Organizations or individuals importing scrap after a period of one year from the date of issuance of the Certificate without conducting the importation, except in cases of force majeure;- Organizations or individuals importing scrap cease operations related to the importation of scrap as production materials or declare bankruptcy, dissolution.

Note: The competent authority that issued the Certificate shall issue a decision to revoke the Certificate it granted, clearly stating the name of the revoked organization or individual, basis, and reason for revocation.
