Decision 01/QD-TANDTC was issued by the Supreme People's Court on January 2, 2019, to specifically regulate cases where officials in the People's Courts are evaluated as not completing their tasks.
Accordingly, Decision 01 stipulates that officials without leadership or management positions who meet any of the following criteria will be classified as not fulfilling their duties:
- Failing to implement or violating the guidelines, policies of the Communist Party, or laws of the State and being disciplined by the competent authority or handled by the competent authority as prescribed;- Violating the discipline, order, or working regulations of the agency, organization, but not to the extent of being disciplined at the highest level;- Failing to fulfill tasks corresponding to the current title;- Committing errors in the execution of tasks requiring remedial measures;- Causing disunity within the unit;- Completing less than 70% of tasks according to the annual work program or plan;- Engaging in bureaucratic, imperious behavior, creating difficulties, inconvenience, negativity, corruption, embezzlement, or wastefulness and being disciplined.- Being held accountable according to the Regulations on the liability of individuals holding judicial positions in the People's Court during the evaluation year.
Additionally, Decision 01 also stipulates that officials in leadership or management positions who meet any of the following criteria will be classified as not fulfilling their duties:
- Being assessed by the competent authority managing the officials to exhibit signs of ideological, political, ethical, lifestyle degradation, or self-evolution, self-transformation;- Having over 50% of the criteria for duties and responsibilities evaluated as not fulfilled;- The unit under management completing less than 50% of assigned or set targets and tasks;- The unit under direct leadership, management, or directly related to negativity, embezzlement, corruption, or wastefulness at agencies, organizations, units assigned to be managed and being handled according to the law;- Directing or organizing the execution of tasks with errors requiring remedial measures;- The agency, organization, or unit assigned to leadership or management experiencing disunity;- Individuals being disciplined or held accountable according to the Regulations on the liability of individuals holding judicial positions in the People's Court during the evaluation year.
