What are the duties and powers of the Commune Police?

The Commune Police Ordinance 2008 was promulgated on November 21, 2008. This Ordinance stipulates the duties and powers of the Commune Police. So, specifically, what duties and powers does the Commune Police have according to this Ordinance?

According to the provisions of Article 9 of the Commune Police Ordinance 2008, the Commune Police have the following duties and powers:

  1. Grasp the situation of security, social order, and safety in the commune area; propose to the Communist Party committee, the People's Committee at the same level, and the superior Police agency on the policies, plans, and measures to ensure security, social order, and safety, and organize the implementation of such policies, plans, and measures.

  2. Take the lead in building the movement of the entire population protecting national security; propagate and disseminate policies, laws on security, social order, and safety; guide, inspect, and urge agencies, organizations, and individuals to implement the legal provisions on security, social order, and safety in the commune area as per the authority.

  3. Advise the Commune People's Committee and organize the implementation of legal provisions on managing and educating subjects who must comply with probation sentences, education without detention, those sentenced to prison but granted a suspended sentence residing in the commune; manage pardonees, those after drug detoxification, and those who have completed prison sentences but are subject to further management as per the legal provisions.

  4. Preside over, cooperate with agencies, organizations, and other forces to prevent, detect, fight against crimes and social evils as per the legal provisions; protect security, social order, and safety; protect the lives and property of individuals, agencies, and organizations in the commune area.

  5. Implement legal provisions on managing residence, citizen identification, and other travel documents; manage explosives, weapons, support tools, fire prevention, and firefighting, environmental protection; manage security, social order for sectors and professions with conditional business activities in the commune area as per the decentralization and guidance of the Minister of Public Security.

  1. Receive, classify, and handle cases of signs of legal violations regarding security, social order, and safety in the commune area as per the authority; inspect individuals, objects, personal identification papers, seize weapons and dangerous tools of those caught in the act of violating the law; organize rescue for victims, protect the scene, and report immediately to the competent authority; prepare initial files, take statements of harmed persons and witnesses, seize and preserve exhibits as per the legal provisions and guidance of the Minister of Public Security; provide files, materials, exhibits, information collected, and facilitate competent authorities to verify and handle cases.

  2. Organize the arrest of offenders caught in the act, those with wanted notices, and those sought who are hiding in the commune area; escort the arrested individuals to the superior Police agency directly.

  3. Penalize administrative violations; prepare files recommending the application of other administrative handling measures for those violating laws in the commune area as per the legal provisions and guidance of the Minister of Public Security.

  4. Request agencies, organizations, and individuals in the commune area to cooperate in activities, provide information, and perform tasks related to ensuring security, social order, and safety.

  5. In urgent cases, to rescue the injured, conduct search and rescue, chase offenders caught in the act, or those with wanted notices, mobilize people and vehicles of organizations and individuals and must return the mobilized vehicles immediately when the situation ends and report immediately to the President of the same level People's Committee.

In case of property damage, compensation must be paid as per the legal provisions; those mobilized for the mission who are injured or die will be resolved according to State policies.

  1. Use weapons and support tools and apply certain police measures as per the legal provisions and guidance of the Minister of Public Security to protect security, social order, and safety in the commune area.

  2. Participate in the enrollment and recruitment into the people's armed forces; practice and drill implementing national defense, security, search and rescue plans, remediate natural disaster consequences, and other serious incidents.

  3. Develop a clean, strong Commune Police force in terms of politics, organization, and profession.

  4. Perform other duties as prescribed by law.
