Vietnam: Implementation of policies on social insurance, unemployment insurance, and health insurance of the Ministry of Labor, Invalids and Social Affairs

According to Clause 3 Article 2 of Decree No. 89/2020/ND-CP of Vietnam’s Government, the implementation of policies on social insurance, unemployment insurance, and health insurance of the Ministry of Labor, Invalids and Social Affairs is prescribed as follows:

1. Promulgate guidance documents on social and health insurance procedures, collection of social, health and unemployment insurance premiums and provision of insurance benefits in compliance with the law; promulgate circumstance-based documents with one-time effect and internal documents for internal control.

2. Consider and process the calculation of work experience for employees who do not have original records indicating their work experience in the state sector before January 01, 1995, according to the guidelines of the Ministry of Labor, Invalids and Social Affairs.

3. Propagate the policies, benefits and the law on social, unemployment and health insurance.

4. Determine, organize registration, supervision and management of people covered by social insurance, unemployment insurance and health insurance according to regulations.

5. Issue the template for social insurance cards, health insurance cards, templates for social insurance and unemployment insurance records, and organize the issuance of social insurance cards and health insurance cards for insurance participants in accordance with regulations.

6. Organize collection or authorize service providers to collect social insurance and health insurance premiums from organizations, employers and individuals in accordance with regulations. Use funding from the State Budget to provide social insurance and health insurance benefits in accordance with regulations.

7. Receive insurance claims and handle cases of illness and maternity; occupational accidents and occupational diseases; pension; death; convalescence after illness and pregnancy and after treatment for occupational accidents and occupational diseases; conduct medical examination and treatment in compliance with the law.

8. Organize the disbursement of social insurance, unemployment insurance, and health insurance benefits or authorize service providers to disburse these insurance benefits in accordance with regulations.

9. Organize the signing of contracts with healthcare facilities that meet the required qualifications and professional standards; inspect and supervise the implementation of healthcare contracts covered by health insurance; organize the implementation of health insurance assessments in accordance with health insurance laws; protect the rights and benefits of health insurance participants and prevent abuse or exploitation of the health insurance system;

10. Inspect contract conclusion process, payment of social, health and unemployment insurance premiums by organizations, employers, individuals; reject illegal payments and claims.

11. Retain dossiers on policyholders of social, health and unemployment insurance in accordance with regulations.

12. Implement measures to limit the evasion and delay of social insurance, unemployment insurance, and health insurance contributions.

13. Provide timely and sufficient information on the insurance premium payment, insurance coverage, procedures for provision of social, health and unemployment insurance benefits at the request of employers, employees or organizations. Provide relevant information and documents at the request of competent authorities in a timely and sufficient manner.
