Vietnam: Grant and revocation of industrial property representation service practice certificates

Recently, the Government of Vietnam issued Decree No. 122/2010/NĐ-CP amending and supplementing a number of articles of Decree No. 103/2006/NĐ-CP detailing and guiding a number of articles of the Law on Intellectual Property regarding industrial property.

Decree No. 122/2010/NĐ-CP of Vietnam’s Government supplements several contents on grant and revocation of industrial property representation service practice certificates specified in Decree No. 103/2006/NĐ-CP as follows:

- Grant of industrial property representation service practice certificates: Industrial property representation service practice certificates shall be granted to applying individuals who satisfy the conditions specified in the Law on Intellectual Property after they pay prescribed fees and charges.

- Revocation of industrial property representation service practice certificates: An industrial property representation service practice certificate is revoked in the following cases:

+ The certificate holder has quitted the job of industrial property representation;

+ The certificate holder no longer satisfies the conditions specified in the Law on Intellectual Property;

+ The certificate holder is deprived of the right to use the certificate under a competent state agency's decision.

Note: An application for re-grant of an industrial properly representation service practice certificate after this certificate is revoked may only be considered upon the expiration of the duration of deprivation of the right to use this certificate.

- The Ministry of Science and Technology shall grant and revoke industrial property representation service practice certificates.
