Vietnam: Cases of suspension of the Certificate of petroleum preparation establishment

According to Circular No. 15/2015/TT-BKHCN of the Ministry of Science and Technology of Vietnam, the Directorate for Standards, Metrology and Quality shall consider and carry out the limited suspension of the validity of the Certificate of petroleum preparation establishment which has been already issued under the following circumstances:

- There is any violation against metrological regulations committed by a preparation establishment;

- A preparation establishment fails to fully implement the quality control plan;

- Petroleum products which fail to meet accepted quality standards and are currently available in the market have been manufactured by this petroleum preparation establishment;  

- The validity of the License for petroleum export and import trading is suspended; 

- This establishment is refused the Certificate of registration of the plan for preparation of finished petroleum materials, importation of materials for preparation of finished petroleum products by competent authorities;

- This establishment has not notified state agencies in accordance with paragraph 3 Article 16 hereof.

Moreover, the Directorate for Standards, Metrology and Quality shall, depending on the seriousness of each violation, consider and carry out the cancellation of the validity of the Certificate of petroleum preparation establishment which has been already issued under the following circumstances:

- Such establishment fails to meet requirements for trade in petroleum export or import and petroleum production;

- The License for petroleum export and import trading held by a petroleum trader is revoked by competent authorities;

- There are a lot of violations committed or the recurring violation against petroleum metrological and quality regulations governing petroleum trading operations.
