The 2015 Civil Procedure Code, passed by the National Assembly on November 25, 2015, consists of 42 chapters and 517 articles, regulating issues related to civil procedural activities. One of the prominent contents stipulated in this document is the rights and obligations of the parties involved in civil proceedings.
To be specific, pursuant to Article 70 of the Civil Procedure Code 2015, the involved parties have the following rights and obligations:
- Respect the Court and strictly comply with the courtroom rules;- Pay the advance court fees, advance charges, court fees, charges, and other procedural costs in accordance with the law;- Provide complete and accurate addresses of their residence or headquarters; during the resolution of the case by the Court, if there is a change of address, promptly notify other involved parties and the Court;- Maintain, change, supplement, or withdraw their requests in accordance with the Civil Procedure Code 2015;
- Provide documents and evidence; prove their lawful rights and interests;- Request agencies, organizations, or individuals holding or managing documents and evidence to provide such documents and evidence to themselves;- Request the Court to verify and collect documents and evidence for cases that they cannot perform by themselves; request the Court to ask other involved parties to present documents and evidence they are holding; request the Court to issue decisions requesting agencies, organizations, or individuals holding or managing documents and evidence to provide such documents and evidence; request the Court to summon witnesses, consult expert opinions, and decide on asset valuation;- Be informed of, record, or copy the documents and evidence presented by other involved parties or collected by the Court, except for documents and evidence specified in Clause 2, Article 109 of the Civil Procedure Code 2015;- Be obliged to send to other involved parties or their lawful representatives copies of the lawsuit petition and documents and evidence, except for documents and evidence that the other involved parties already have, documents and evidence specified in Clause 2, Article 109 of the Civil Procedure Code 2015. In case of justifiable reasons for not being able to copy and send the lawsuit petition, documents, and evidence, they have the right to request the Court's assistance;- Request the Court to decide to apply, change, or cancel provisional urgent measures;- Reach mutual agreements on resolving the case; participate in conciliation conducted by the Court;- Receive valid notifications to exercise their rights and obligations;- Self-defend or seek others to defend their lawful rights and interests;- Request the replacement of procedure-conducting persons or participants;- Attend court hearings and meetings;- Be present according to the Court's summons and comply with the Court's decisions during the resolution of the case;- Request the Court to involve persons with related rights and obligations in the proceedings;- Request the Court to suspend the resolution of the case in accordance with the Civil Procedure Code 2015;- Pose questions to others about issues related to the case or propose to the Court issues to be questioned of others; confront each other or witnesses;- Debate at the court hearing, present arguments on evidence assessment, and applicable laws;- Receive excerpts, judgments, and decisions of the Court;- Appeal, complain against the judgments and decisions of the Court;- Request competent persons to protest according to the cassation and reopening procedure against the effective judgments and decisions of the Court;- Strictly comply with the effective judgments and decisions of the Court;- Exercise their rights in good faith, not hindering the procedural activities of the Court and other involved parties; in case of failure to fulfill obligations, bear the consequences as prescribed by the Civil Procedure Code 2015;- Other rights and obligations as prescribed by law.
The involved parties have equal rights and obligations during the proceedings.
