Decree 67/2018/ND-CP issued by the Government of Vietnam on May 14, 2018, stipulates detailed provisions of certain articles of the Law on Irrigation.
The license for activities within the scope of hydraulic construction protection is suspended if the licensed organization or individual commits one of the following violations:
- Violates the content specified in the license;- Takes advantage of the license to organize activities that violate legal regulations;- Duration of license suspension: Not more than 03 months.- During the period when the license is suspended, the licensed organization or individual must not perform any rights related to the license and must take measures to remedy the consequences and compensate for the damages according to legal regulations.
According to Decree 67, the License will be revoked if:
- The contents declared in the application for the license are found to be untrue;- The licensed organization or individual is dissolved or declared bankrupt by the court; is deceased, declared deceased by the court, loses civil act capacity, or is declared missing;- The licensed organization or individual violates the decision to suspend the license;- Cases of ensuring national defense, security, or for national or public interest.- Regarding the authority to revoke the license: The competent authority to grant the license according to the law has the authority to decide to revoke the license.
According to Decree 67, the Ministry of Agriculture and Rural Development is responsible for inspecting and supervising the issuance and implementation of licenses for activities within the scope of hydraulic construction protection nationwide.
The People's Committees at all levels are responsible for inspecting and supervising the issuance and implementation of licenses for activities within the scope of the protection of hydraulic constructions in their localities.
