Supervision and Education Policy for Juvenile Offenders Under 18 Years Old

On March 10, 2018, the Government of Vietnam promulgated Decree 37/2018/ND-CP detailing the implementation of supervision and education measures for individuals under 18 years of age who commit crimes and are exempt from criminal liability.

The State promulgates policies to supervise and educate individuals under 18 years old who are exempted from criminal liability through community-oriented activities as follows:

- Organize the supervised and educated individuals to fulfill their obligation to participate in the Learning Program;- General education institutions and continuing education institutions in the national education system are responsible for admitting the supervised and educated individuals to study according to the Supervision and Education Plan;- The heads of general education institutions and continuing education institutions, based on the needs, level, and actual capacity of their facilities, should arrange for support personnel to help supervised and educated individuals integrate and complete the Learning Program;- Organize the supervised and educated individuals to fulfill their obligation to participate in the Vocational Training Program;- Based on the Supervision and Education Plan, the individuals directly supervising and educating shall report to the Chairman of the Commune People's Committee to contact the Department of Labor - Invalids and Social Affairs to propose vocational training support for the supervised and educated individuals.- Based on the health conditions, abilities, and aspirations of the supervised and educated individuals, the Department of Labor - Invalids and Social Affairs is responsible for contacting vocational training institutions, Job Placement Centers, other organizations, individuals, production, and business establishments in the area to arrange for the supervised and educated individuals to participate in an appropriate Vocational Training Program. Organize the supervised and educated individuals to fulfill their obligation to participate in labor activities in the community.- The Youth Union, Women's Union, or other social organizations, agencies, and other organizations will organize labor activities in the community, assisting the elderly, disabled individuals, those in special circumstances, or other voluntary activities to enhance the awareness, responsibility, and community engagement of the supervised and educated individuals.- Community labor activities must comply with labor laws, be appropriate to the age and health of the supervised and educated individuals, and not affect their studies.

Decree 37/2018/ND-CP is effective from March 10, 2018.
