Recently, the Government of Vietnam issued Decree 114/2018/ND-CP on the management of dam and reservoir safety, stipulating the management of dam and reservoir safety for dams with a height of 5 meters or more or reservoirs with a total capacity of 50,000 cubic meters or more and safety for the downstream areas of the dam.
During the construction process, the investor in building dams and water reservoirs must develop a disaster response plan. To be specific: regarding the dossier, content, and procedure for appraisal, they are defined as follows:
1. Dossier for appraisal
- Request for approval of the disaster response plan for the project, downstream area of the dam;- Draft disaster response plan for the project, downstream area of the dam;- Technical calculation results report;- Written comments from relevant agencies and units;- Other related documents attached (if any).
2. Appraisal content
- Check the legal basis of the dossier submitted for appraisal approval;- Examine and assess the reliability of documents used to develop the plan;- Provide comments and assess the reasonableness of the dossier and the draft plan.
3. Appraisal procedure
- Within 03 working days from the date of receipt of the dossier, the receiving agency is responsible for reviewing and inspecting the dossier; in case the dossier is not valid, the receiving agency must notify the organization or individual requesting approval in writing to complete the dossier as per regulations;- Within 20 working days from the date of receipt of a complete valid dossier, the receiving agency is responsible for appraising the dossier, conducting on-site inspections when necessary, and submitting it to the competent authority for consideration and approval; in case the approval conditions are not met, the receiving agency must return the dossier to the organization or individual requesting approval and notify the reason in writing.
