Circular 19/2018/TT-BCT has been promulgated by the Ministry of Industry and Trade regulating the drafting and issuance of legal normative documents of the Ministry of Industry and Trade.
According to the new regulation, the proposal process for a law, ordinance, or resolution by the Ministry of Industry and Trade will undergo verification before appraisal. To be specific:
1. The Legal Department is responsible for verifying the proposals for laws, ordinances, and resolutions prepared by various units within the Ministry before submitting them to the Ministry of Justice for appraisal.
- The dossier sent to the Legal Department for verification includes the documents specified in Clause 1, Article 8 of Circular 19.- No later than September 30 each year, the unit proposing the development of laws, ordinances, and resolutions must submit the proposal dossier to the Legal Department for verification.
2. The Legal Department shall verify the proposal dossier for the development of laws, ordinances, and resolutions within 15 days from the date of receipt of the complete dossier from the proposing unit.
3. The verification content focuses on the issues specified in Clause 3, Article 39 of the Law on Promulgation of Legal Documents.
4. The verification report must clearly state the opinions of the Legal Department on the verification content specified in Clause 3 above and on whether the proposal for the development of laws, ordinances, and resolutions is sufficiently qualified or not to be sent to the Ministry of Justice for appraisal before being submitted to the Government of Vietnam for consideration and approval.
Circular 19/2018/TT-BCT is effective from September 3, 2018, replacing Circular 08/2016/TT-BCT.
