A securities practitioner is a person who has been granted a securities practice certificate by the State Securities Commission and is currently working at a securities company, a fund management company, or an investment company. The responsibilities of a securities practitioner are stipulated in Circular 197/2015/TT-BTC as follows.
1. Except in cases where appointed as a representative of contributed capital or as a member of the board of directors, the members' council, or the supervisory board of an organization that owns a securities business organization or receives investment capital from a securities business organization, securities practitioners shall not:
- Simultaneously work for another organization that has ownership relations with the securities company, the fund management company where they are currently employed;- Simultaneously work for another securities company or fund management company;- Simultaneously serve as the director (general director) of an organization offering securities to the public or a listed organization.
2. Securities practitioners working for a securities company are only allowed to open securities trading accounts for themselves at the very securities company where they are employed, except when the securities company is not a member of the Stock Exchange.
3. Securities practitioners shall not use the money or securities in a customer's account without being authorized by the securities company through the customer's written authorization to the securities company.
4. Securities practitioners must comply with the code of ethics for securities practice.
5. Securities practitioners must participate in training courses on laws, trading systems, and new types of securities organized by the State Securities Commission or the Stock Exchange.
6. Securities practitioners must notify the State Securities Commission after their securities practice certificates are lost, found to be lost, or when there is a change in the personal information in the securities practice certificates.
