On October 31, 2017, the Vietnam’s Government Office issued Circular No. 02/2017/TT-VPCP, which specifies requirements for the announcement of administrative procedures.
According to Circular No. 02/2017/TT-VPCP of Vietnam’s Government Office, the announcement of administrative procedures, work settlement procedures (hereinafter referred to as administrative procedures) is to ensure the full, accurate, consistent, unified, transparent, and timely implementation of administrative procedure regulations, facilitating competent state agencies and the people to inspect and supervise the handling of administrative procedures.
When announcing administrative procedures, the following requirements must be met:
- Administrative procedures must be announced in the form of decisions by the Ministers, Heads of ministerial agencies, Presidents of People’s Committee of provinces, and the head of the agency or unit entrusted by the higher-level state agency with the task or authorized to issue documents guiding the implementation of work settlement procedures for individuals or organizations.
- The announced administrative procedures must be within the jurisdiction and follow a strict process to ensure reliability, accuracy, completeness, timeliness, and compliance with prescribed deadlines.
- The decision on announcement by the Ministers, Heads of ministerial agencies, Presidents of People’s Committee of provinces must ensure the full and accurate content regarding administrative procedures in legal documents and be issued within the prescribed deadline.
- The decision on announcement by the Director-General of the Vietnam Social Security Agency, the Vietnam Development Bank, the Social Policy Bank (hereinafter referred to as the Director-General of the Agency) must ensure the full and accurate content regarding procedures in legal documents and documents guiding the implementation of work settlement procedures for individuals or organizations. It has enforceable value for the system of subordinate agencies nationwide and relevant organizations and individuals.
