Regulations on the Deadline for Submitting Periodic Reports to the Focal Unit of the Ministry of Health (MOH)

Recently, the Minister of Health signed and promulgated Circular 38/2019/TT-BYT stipulating the policies for periodic reporting under the state management scope of the Ministry of Health.

Article 3 Circular 38/2019/TT-BYT stipulates the deadlines for submitting periodic reports to the focal unit of the Ministry of Health as follows:

- Monthly Report: No later than the 20th of the reporting month;- Quarterly Report: No later than the 20th of the last month of the reporting quarter;- Semi-Annual Report: No later than June 20 each year;- Annual Report: No later than December 20 each year.

Based on this regulation, entities reporting to the Ministry of Health can stipulate deadlines for submitting reports but must ensure the time frame for finalizing periodic report data in accordance with Article 12 of Decree 09/2019/ND-CP.

Circular 38/2019/TT-BYT stipulates that the components of periodic report policies must comply with the general regulations in Clauses 1, 2, 3, 4, 5, 6, 7, 8, 9 of Article 7 and meet the corresponding requirements stated in Article 8 of Decree 09/2019/ND-CP and the detailed regulations in this Circular, except in cases specified otherwise in documents from the National Assembly, the Standing Committee of the National Assembly, the Provincial People’s Councils, and competent authorities within the state administrative system.

Reports can be in paper form or electronic documents signed and stamped by the authorized personnel of the agency or unit; they can be sent through the Ministry of Health’s electronic document management system (including Word, Excel files) or sent directly, via postal services, or via the email system. However, for reports that have a reporting software system, they must be sent through the software, using approved digital signatures and do not need to send paper reports, except in cases of technical failures or force majeure events where paper reports must be submitted.
