Regulations on Construction Works under Emergency Orders and Temporary Construction

Circular 52/2018/TT-BTC has been issued by the Ministry of Finance to amend and supplement a number of articles of Circular 08/2016/TT-BTC, stipulating the management and payment of investment capital using state budget funds.

Construction projects under emergency and urgent orders and temporary construction are stipulated in Circular 52 as follows:

Types of construction projects under emergency and urgent orders as stipulated in Clause 2, Article 42 of Decree 59/2015/ND-CP.
Types of temporary construction projects as stipulated in Clause 3, Article 42 of Decree 59/2015/ND-CP.
Advance payment, capital settlement:

- Advance payment: The advance payment amount and its recovery are carried out according to the regulations for state budget investment capital. The advance payment dossier includes:- Emergency order from the competent authority or document authorizing the implementation of the project under an emergency order from the competent authority;- Decision approving the investment project for the emergency or temporary construction by the competent authority;- Investment capital payment proposal document;- Money transfer voucher.- Advance payment guarantee from the contractor;- Payment for completed volume: carried out according to the regulations for state budget investment capital.
