On July 16, 2017, the Ministry of National Defense issued Circular 162/2017/TT-BQP specifying policies regarding retired professional soldiers.
Circular 162 stipulates that professional soldiers who cease active service, do not meet the conditions for retirement, are not eligible for sick leave policies or cannot be transferred to another sector, shall be demobilized; upon demobilization, they shall receive allowances and policies as prescribed in Article 4 of Decree 151/2016/ND-CP. Among these, one-time demobilization allowances are implemented as follows:
One-time demobilization allowance = Total number of working years x 01 month of salary prior to demobilization
Example: Comrade Nguyen Van H, professional soldier lieutenant, has served in the Army for 12 years and 8 months (with 12% seniority); demobilized from May 1, 2017. As of April 2017, Comrade H had a salary coefficient of 4.40, a statutory pay rate of 1,210,000 VND/month; the salary for April 2017 of Comrade H was:
1,210,000 VND x 4.40 x 1.12 = 5,962,880 VND.
When Comrade H demobilized, he received a one-time demobilization allowance as prescribed, as follows:
- The time served in the Army is 12 years and 8 months, rounded up to 13 years.- The one-time demobilization allowance is: 5,962,880 VND x 13 years x 01 month = 77,517,440 VND.
At the same time, Circular 162 also stipulates that in cases where professional soldiers have directly participated in combat, served in combat, or worked in difficult areas with specific professional characteristics, upon demobilization, they shall receive a one-time allowance for the additional time converted according to the provisions in Article 7 of Decree 151/2016/ND-CP and Articles 8 and 9 of this Circular.
Professional soldiers who have received one-time social insurance upon demobilization, within no more than one year (12 months) from the effective date of the demobilization decision, if they wish to retain the previously paid social insurance time, it shall be implemented according to the guidance in Clause 8, Article 17 of Joint Circular 105/2016/TTLT-BQP-BCA-BLDTBXH and Decree 33/2016/ND-CP on compulsory social insurance for military personnel, public security personnel, and persons doing cipher work receiving salaries akin to military personnel.
