This is the basic content stipulated in Circular 05/2018/TT-BCA on regulations regarding the collection of documents and the preparation of dossiers proposing the application of administrative handling measures for mandatory rehabilitation, issued on February 7, 2018.
The process of reviewing the dossier for requesting the application of administrative measures to send to mandatory rehabilitation facilities is regulated as follows:
- After completing the compilation of the dossier, the police authority where the dossier is compiled must directly send or post a notification of the compilation of the dossier to the individual proposed for the application of administrative measures to be sent to a mandatory rehabilitation facility or their legal representative.
- The reading of the dossier by the individual proposed for the application of being sent to a rehabilitation facility or their legal representative must be recorded in minutes.
- The dossier reading is to be conducted during office hours at the office of the dossier compiling authority or a convenient location selected by the dossier compiling authority. The time frame for reading the dossier is 5 days from the date of receiving the notification.
- The dossier compiling police authority is responsible for appointing an officer to supervise the dossier reading, preparing a photocopy of the dossier for the reading (the original dossier will only be shown upon the request of the dossier reader for comparison).
- After the 5-day period from the date of receiving the notification, if the notified individual does not read the dossier according to the notification, the procedures for compiling the dossier will still be carried out as regulated.
