On March 10, 2018, the Government of Vietnam issued Decree 37/2018/ND-CP detailing the implementation of measures for monitoring and educating individuals under 18 years of age who commit crimes and are exempt from criminal liability.
Decree 37 stipulates that commune-level police assist the Chairman of the same-level People's Committee in establishing and managing files for the enforcement of supervision and education measures for supervised and educated individuals.
Files for the enforcement of supervision and education measures include the following documents:
- Initial documents as prescribed by law;- Decision on assigning personnel for direct supervision and education;- Minutes of notification on the enforcement of supervision and education measures;- Report on information collection, identification of risk factors, causes, and conditions of the law violations by the supervised and educated individual;- Supervision and education plan;- Commitment of the supervised and educated individual regarding adherence to the supervision and education measures;- Logbook on the implementation status of the supervision and education plan;- Monthly periodic reports by the personnel directly supervising and educating on the results of supervision and education;- Attendance minutes;- Summary report on the results of supervision and education;- Certificate of completion of reprehension measures and community mediation measures;- Other related documents.
In addition to the documents mentioned above, except for the initial files as prescribed by law, the files for the enforcement of education measures at the commune, ward, and commune-level town include the following documents:
- Documents regarding absence from the place of residence;- Decision on the termination of the educational period at the commune, ward, and commune-level town;- Certificate of completion of the education measures at the commune, ward, and commune-level town.
Decree 37/2018/ND-CP takes effect from March 10, 2018.
