Procedure for Height Approval of Works Ensuring Aviation Safety

Decree 32/2016/ND-CP has been signed and issued by the Government of Vietnam on the management of the height of aviation obstacles and the positions responsible for the management and protection of the airspace in Vietnam. This document replaces Decree 20/2009/ND-CP.

According to the new regulations, the approval process for the height of structures is carried out as follows:

- From the date of receiving a complete and valid dossier, the Department of Operations - General Staff of the Vietnam People's Army is responsible for inspecting, appraising, and issuing a written approval or disapproval to the agency, organization, or individual requesting approval for the height of the structure. At the same time, they must inform the local construction licensing authority, the Civil Aviation Authority of Vietnam, the Vietnam Air Traffic Management Corporation, the regional Airports Authority, and related agencies and units.- In case the dossier is not valid, within 10 working days from the date of receipt of the dossier, the Department of Operations - General Staff of the Vietnam People's Army must issue a written notice to the agency, organization, or individual requesting approval for the height of the structure to supplement and complete the dossier.- In case of disapproval of the height of the structure, within 10 days, the Department of Operations - General Staff must issue a written notice, clearly stating the reasons, to the agency, organization, or individual requesting approval for the height of the structure.

Decree 32/2016/ND-CP takes effect from June 26, 2016.
