New Regulations on Consolidation of Legal Normative Documents

The consolidation of documents is essential to facilitate the correct application of the law. Circular 19 stipulates the following regarding the consolidation of legal normative documents:

1. Amendments and supplements of certain articles of legal normative documents must be technically consolidated with the documents being amended or supplemented.

2. Heads of units under the Ministry are responsible for organizing the consolidation of legal normative documents for documents drafted by their units once they are amended or supplemented. The consolidated document must ensure accuracy in terms of content and consolidation technique and must be submitted to the Minister for authentication signing according to the following timeline:

- For legal normative documents of the Government of Vietnam, or the Prime Minister of the Government of Vietnam: within 05 working days from the date of receipt of the amendment or supplement document sent by the Office of the Government of Vietnam, the drafting unit is responsible for completing the consolidation and submitting it to the Minister for authentication signing;- For circulars/joint circulars: within 05 working days from the issuance date, the drafting unit is responsible for completing the consolidation and submitting it to the Minister for authentication signing.

3. After completing the consolidation of legal normative documents, the drafting unit shall send the electronic .doc format of the document to the Legal Department for updating on the National Database of Laws; at the same time, send it to the Office of the Ministry for publication on the Government of Vietnam's e-Portal and the electronic Gazette:

- For legal normative documents of the Government of Vietnam, or the Prime Minister of the Government of Vietnam: the drafting unit shall send the consolidated document to the Ministry's Office to forward to the Government Office for publication on the Government of Vietnam's e-Portal and for posting in the electronic Gazette within 02 working days from the date the Minister signs the authentication;- For circulars/joint circulars: the drafting unit shall send the consolidated document to the Ministry's Office to publish on the Ministry of Industry and Trade's e-Portal and post in the electronic Gazette immediately after the Minister signs the authentication on the document.

4. Reporting regime: The unit responsible for consolidating legal normative documents is required to report on the situation of consolidating legal normative documents for their unit periodically every 06 months, annually or irregularly to the Legal Department for compilation, and report to the Ministry's leadership.
