Marriage Registration Procedure for Migrants in Vietnamese Districts Bordering Laos

Circular 03/2015/TT-BTP stipulates the conditions, order, and procedures for acquiring Vietnamese nationality, birth registration, and marriage registration for free migrants in the districts of Vietnam adjacent to Laos, issued by the Minister of Justice on April 1, 2015.

Circular 03/2015/TT-BTP stipulates that the People's Committee at the commune level of the border district where both parties reside carries out marriage registration for the following cases:

- Laotian individuals migrating to districts of Vietnam adjacent to the Vietnam-Laos national border, who are permitted to reside in Vietnam under Clause 1, Article 3 of the Agreement approved by the Head of the Vietnam Border Delegation (hereinafter referred to as Laotian migrants permitted to reside).- Vietnamese citizens migrating to districts of Laos adjacent to the Laos-Vietnam national border, who are not permitted to reside in Laos under Clause 1, Article 3 of the Agreement and returned by the Laotian side, approved by the Head of the Laos Border Delegation and received by the Head of the Vietnam Border Delegation.

Both parties shall submit the Marriage Registration Declaration (according to the form issued with this Circular) to the People's Committee at the commune level.

Processing time: Within 01 working day from the receipt of the Marriage Registration Declaration, if both parties meet the marriage conditions as prescribed by the Law on Marriage and Family, the Civil Status - Justice officer shall record the marriage in the Marriage Registration Book, Marriage Certificate, and report to the Chairman of the People's Committee at the commune level for signing and issuing the Marriage Certificate to both parties.

Note: When registering the marriage, both parties must be present and sign with the Civil Status - Justice officer in the Marriage Registration Book and Marriage Certificate; if unable to sign, they shall fingerprint. In cases where marriage conditions need to be verified, the processing time shall not exceed 03 working days.
