Key Points Market Surveillance Officials Need to Note When Using Seals and Certificates

This is a noteworthy content mentioned by the Ministry of Industry and Trade in Circular 26/2013/TT-BCT stipulating the sample minutes and decisions used in inspection activities and the imposition of administrative sanctions by Market Management.

According to the provisions of Circular 26/2013/TT-BCT, when being assigned to use the templates of minutes and decisions in inspection activities and the templates of minutes and decisions (hereinafter referred to as administrative documents) used in the administrative sanctions of Market Management, Market Management officers must use as follows:

- Use the correct type of administrative documents for each task according to the legal provisions on inspection and administrative sanctions;- Use administrative documents sequentially from the smallest number to the largest number, without skipping or jumping numbers. In case an administrative document number is damaged, cross out that number, retain the damaged administrative document number in the administrative document book, and proceed to use the next number;- Write the pre-printed administrative document using a blue or black ink ballpoint pen on the top copy so that the carbon ink self-prints onto the subsequent copies, or write the administrative document on a typewriter, printer with black ink, ensuring the content between the copies must be identical;- Accurately fill in the administrative document as per regulations, without adding or omitting any content on the pre-printed administrative document template. Any section of the administrative document that is not filled in or partially filled must be crossed out, and the remaining blank part must be struck through; in the case of attached appendices, it must be clearly noted that there are appended documents or itemized lists attached;- Administrative documents with multiple pages or copies, including cases where appendices or itemized lists are used, must bear the signatures of the aforementioned individuals on each page and each copy of the administrative document made;- Include the specified administrative document copies in the case file for inspection and administrative sanction cases; file-index the administrative documents in the case file and any other related documents as per the legal provisions on handling administrative violations.
