Issuance of Permits for Activities within the Protective Scope of Water Conservancy Works

Decree 67/2018/ND-CP stipulates the procedures and steps for issuing permits for activities within the scope of irrigation infrastructure protection as follows:

- Within 3 working days from the date of receipt of the application, the receiving agency shall review and examine the application; if the application is insufficient, the receiving agency shall notify the organization or individual requesting the permit to complete the application as per the regulations;

- Time limit for issuing permits for the following activities:

- Construction of new projects;- Establishment of docks, depots for raw materials, fuels, materials, equipment, vehicles;- Drilling, geological surveying; mineral exploration and exploitation, construction material extraction, groundwater extraction;- Construction of underground works.

Within 25 working days from the date of receiving a complete and valid application, the competent authority shall appraise the application and issue the permit if the conditions are met; if conditions are not met, the reasons for not issuing the permit shall be notified.

- For the activity: Discharging wastewater into irrigation works, except for small-scale and non-toxic, non-radioactive wastewater discharges, within 30 working days from the date of receiving a complete and valid application, the competent authority shall appraise the application and issue the permit if the conditions are met; if conditions are not met, the reasons for not issuing the permit shall be notified.

- For the activity of planting perennial trees:

Within 10 working days from the date of receiving a complete and valid application, the competent authority shall appraise the application and issue the permit if the conditions are met; if conditions are not met, the reasons for not issuing the permit shall be notified.

- For the activity:

- Tourism, sports, scientific research, business, service activities;- Aquaculture;- Blasting and other explosive activities;

Within 15 working days from the date of receiving a complete and valid application, the competent authority shall appraise the application and issue the permit if the conditions are met; if conditions are not met, the reasons for not issuing the permit shall be notified.

- For the activity of inland waterway vehicles, motor vehicles, except motorbikes, bikes, and rudimentary inland waterway vehicles:

Within 7 working days from the date of receiving a complete and valid application, the competent authority shall appraise the application and issue the permit if the conditions are met; if conditions are not met, the reasons for not issuing the permit shall be notified.
