Instruction on determining the scope of the navigable waterway protection corridor in special cases

Decree 24/2015/ND-CP stipulates detailed regulations and measures for the implementation of certain provisions of the Law on Inland Waterway Traffic and the Law on Amendments and Supplements to Certain Provisions of the Law on Inland Waterway Traffic, promulgated on February 27, 2015.

Decree 24/2015/ND-CP guides the determination of the scope of the protection corridor for inland waterways in the following special cases:

1. In cases where the scope of the protection corridor for inland waterways coincides with the safety corridor of road bridges and railway bridges, the scope of the protection corridor is calculated from the edge of the waterway to the natural riverbank and implemented according to the regulations of the law on the protection of road and railway bridge safety corridors.

2. In cases where the scope of the protection corridor for inland waterways coincides with the maritime channel protection corridor, implementation follows the regulations of the law on the protection of maritime channel corridors.

3. In cases where the scope of the protection corridor for inland waterways coincides with the scope of protection of disaster prevention and control works, dykes, and irrigation works, implementation follows the regulations of the law on disaster prevention and control, dyke protection, and the law on exploitation and protection of irrigation works.

4. For inland waterway routes that have been approved for planning, the determination of the scope of the protection corridor for inland waterways must be based on the technical grade of the inland waterway according to the planning to implement.

5. When preparing investment projects for new construction or upgrading, expanding inland waterway routes, the project investor must base on the inland waterway system planning to clearly determine the technical grade of the inland waterway route, simultaneously determine the scope of the protection corridor for the inland waterway, develop a plan, and implement boundary marker planting after completing the project.
