How Do State Agencies Adjust Staffing to Implement Autonomy Policies?

the Government of Vietnam issued Decree No. 117/2013/ND-CP amending and supplementing several articles of Decree No. 130/2005/ND-CP dated October 17, 2005 of the Government of Vietnam on policies of autonomy and self-responsibility regarding the utilization of staffing and administrative management funds for state agencies.

To be specific, in Clause 8 of Decree 117/2013/ND-CP, which amends and supplements Article 9 of Decree 130/2005/ND-CP, stipulates that the staffing quotas shall be considered for adjustment as per the regulations in Article 11 of Decree 21/2010/ND-CP dated March 8, 2010, by the Government of Vietnam on managing civil servant payrolls and Clause 2, Article 9 of Decree 36/2013/ND-CP dated April 22, 2013, by the Government of Vietnam on job positions and civil servant ranks structure and other related regulations.

Furthermore, the Decree stipulates that the level of funding allocated for the year to implement self-management policies shall be considered for adjustment in the following cases:

- Due to adjustment of staffing as regulated in Clause 1 of this Article;- Adjustment of tasks according to the decision of the competent authority;- The State changes salary policies, changes the standards for state budget allocation, adjusts the allocation ratio for administrative management.

Note, when factors arise that change the allocated funding level, the agency implementing self-management policies must issue a written proposal to adjust the budget estimate, detailing the factors that increase or decrease the budget estimate, and send it to the immediate superior management agency. The immediate superior management agency (if it is not a level I budget unit) reviews, consolidates the estimates of subordinate units, and submits them to the level I budget unit. Central and local state agencies (level I budget units) review the estimates submitted by subordinate units, consolidate and prepare the budget spending estimates within their management scope, and send them to the financial agency at the same level to submit to the competent authority for decision.
