Guidelines for the Implementation of Forest Planting and Protection Projects by State-established Organizations

Recently, the Ministry of Planning and Investment issued Circular 02/2018/TT-BKHDT guiding the implementation of certain contents of Decision 38/2016/QD-TTg on policies for the protection, development of forests, investment support for infrastructure, and assignment of public tasks to agricultural and forestry companies.

Circular 02 provides guidance on the implementation of projects for forest planting, protection, and development by organizations established by the State as the investor as follows:

- The implementation of projects for forest protection and development, forest planting, and regeneration with supplementary planting must be stably contracted to the local people from the planting, care, and protection stages according to the forestry cycle and according to the benefits stipulated in Decision 38/2016/QD-TTg.- The investor signs contracts for forest planting, protection, and development with households or groups of households participating in forest planting, which includes technical design guidance and approved forestry project estimates.- The people who are contracted forest land for planting and development may self-plant forests in advance and are supported afterwards according to the stipulated standards.- For forest land already allocated to people for long-term stable use, individuals have the right to self-plant forests in advance. The areas planted into forests will be prioritized for inclusion in the provincial forest planting, protection, and development projects with post-investment support and financial assistance according to the regulations.- The list of households participating in forest planting and development shall be publicly posted at the commune People's Committee office and village/local cultural houses, indicating the area and amount received.- For forest planting land of agricultural and forestry companies that have been converted to joint stock companies in which the State holds more than 50% of charter capital, stable long-term contracts will be given to households when receiving support to implement forest planting projects.

Circular 02/2018/TT-BKHDT is effective from June 29, 2018, replacing Joint Circular 04/2013/TTLT-BKHDT-BNNPTNT-BTC.
