Circular 55/2017/TT-BTC was promulgated by the Ministry of Finance on May 19, 2017, providing specific guidance on the organization of state budget collection.
Circular 55 stipulates that agencies and units assigned to collect state budget revenues must organize the collection according to legal regulations for each revenue item and the Ministry of Finance's guidelines on state budget collection and payment. To be specific:
- Collecting fees and charges: Implement the payments to the state budget according to the provisions of the Law on Fees and Charges, the Law on State Budget, and guiding documents.- Revenue from liquidation of state assets, revenue from the sale of assets attached to land, and transfer of land use rights: Implement the payments to the state budget according to the provisions of the Law on Management and Use of State Assets, the Land Law, the Law on State Budget, and guiding documents.- Revenue from administrative fines: Implement the payments of all collected amounts to the state budget according to the provisions of the Law on Handling of Administrative Violations, the Law on State Budget, and guiding documents.
Simultaneously, Circular 55 also stipulates the responsibilities of the Ministry of Public Security and agencies and units as follows:
- The collecting agency or unit shall cooperate with the financial agency at the same level and the State Treasury where transactions are conducted to ensure correct, sufficient, and timely collection of revenues and remittance to the state budget according to legal regulations.- The head of the agency or unit is responsible for urging and inspecting agencies, units, and individuals directly involved in the collection to fully and timely submit the payments to the state budget.- The upper-level management agency and the Ministry of Public Security are responsible for inspecting and controlling the revenues within the annual budget estimates and other lawful revenues. They should compile and report the state budget collections according to the prescribed policies.- Execute periodic and ad-hoc reporting policies as required by competent state agencies.
