Recently, the Government of Vietnam has signed and promulgated Decree 08/2020/ND-CP stipulating the organization and operation of Bailiffs.
According to the regulations, Thua Phat Lai is a person who meets the standards appointed by the State to perform service, create notary records, verify the conditions for civil judgment enforcement, and organize the enforcement of civil judgments as stipulated by Decree No. 08/2020/ND-CP and related laws. From February 24, 2020, Thua Phat Lai can perform the following tasks:

- Serve documents, records, and papers as prescribed by this Decree and related laws.- Create notary records at the request of individuals, agencies, and organizations as stipulated by this Decree.- Verify conditions for judgment enforcement at the request of litigants and related interested parties as stipulated by this Decree and related laws.- Organize the enforcement of court judgments and decisions at the request of litigants as stipulated by this Decree and related laws.
Furthermore, Decree No. 08/2020/ND-CP stipulates that within their duties, powers, and obligations, individuals, agencies, and organizations must cooperate with Thua Phat Lai, the Thua Phat Lai Office in carrying out the tasks of Thua Phat Lai as prescribed by this Decree and related laws; they must not disclose information regarding the tasks performed by Thua Phat Lai, except as otherwise provided by law. Any act of obstructing, illegally interfering with the activities of Thua Phat Lai, the Thua Phat Lai Office, unlawfully refusing requests from Thua Phat Lai, or disclosing information about the tasks performed by Thua Phat Lai will be dealt with in accordance with the law and must compensate for damages (if any) as prescribed by law.
