The content is specifically stipulated in Circular 01/2016/TT-BTP issued by the Ministry of Justice on February 1, 2016, guiding the implementation of administrative management procedures in the enforcement of civil judgments.
Circular 01 stipulates that the payment of money and the return of assets will be carried out in one of the following forms:
- The involved party directly comes to receive the money at the head office of the enforcement agency. In this case, the Enforcement Officer shall request the accounting and treasury departments to carry out the money payment procedures;
- The involved party authorizes another person to receive on their behalf. Specifically:
- In this case, the authorized recipient must have a legal authorization document accompanied by one of the following papers: citizen identity card; identity card; passport; confirmation paper from the Commune People’s Committee where the person resides for verification (the above documents must be originals).- The enforcement file retains a photocopy of the authorization document, citizen identity card, identity card, passport, or confirmation paper from the Commune People’s Committee; the accounting documents retain the original authorization document and a photocopy of the citizen identity card, identity card, passport, or confirmation paper from the Commune People’s Committee;
- The involved party requests money transfer via post or bank transfer. Accordingly, Circular 01 stipulates:
- In this case, the involved party must have a request form for money transfer via post or bank transfer. The request form specifies the name and address of the recipient, account number (in the case of a bank transfer), and is sent directly or via post.- Based on the request form of the involved party, the Enforcement Officer shall request the accountant to issue a payment slip and carry out the money transfer to the involved party via post or bank transfer. The fee for money transfer via post or bank transfer shall be borne by the recipient and deducted from the amount they are to receive. The postal transfer slip and the money receipt notification (photocopy) are to be stored in the enforcement file along with the payment slip, the original to be retained in the accounting department.
