Exceptions for Calculating Seniority in Cipher Profession

Circular 01/2016/TT-BQP was issued by the Ministry of National Defense on January 04, 2016, detailing exceptions for calculating encryption profession age.

Accordingly, Circular 01 stipulates that in addition to the cases where the age of service in the cipher profession is calculated as prescribed by law, the following cases will also be considered:

- Individuals engaged in cipher work who are seconded or sent to study at institutions outside the cipher organization with the approval of the competent authority.- Individuals engaged in cipher work who are sick, injured, or on maternity leave and are sent by the competent authority for treatment or rehabilitation at medical facilities or convalescent centers within or outside the cipher organization, or receive treatment at home.- Individuals engaged in cipher work who go missing for less than 6 months during the resistance wars against the French, the Americans, or during the war to protect the Fatherland, if confirmed by the head of the cipher-using organization that there is no evidence of surrender to the enemy, betrayal of the Fatherland, or voluntarily leaving the job within the cipher organization.- Individuals engaged in cipher work who are captured by the enemy and later return to the organization or unit, if there is no evidence of surrender to the enemy or betrayal of the Fatherland, the time spent in captivity will still be counted as service in the cipher profession.- Individuals engaged in cipher work who are wrongfully convicted by the Court and are declared not guilty by the competent Court, the time spent off work due to detention, custody, or serving the sentence will still be counted as service in the cipher profession; if wrongfully disciplined by being dismissed or temporarily suspended, and later corrected by the competent authority, the time spent off work due to wrongful discipline will still be counted as service in the cipher profession.- Individuals engaged in cipher work who are sentenced to non-custodial reform or probation and are assigned to supervisory and educational duties by the cipher organization may continue to work, and the sentencing period will still be counted as service in the cipher profession.- Individuals engaged in cipher work who commit a crime and are sentenced to prison, after serving the prison sentence and if not dismissed from the cipher organization, the time worked before the imprisonment will still be counted as service in the cipher profession.- Individuals engaged in cipher work who resign or transfer to another sector for less than 12 months, if reappointed to cipher work by a competent authority, the time spent off or in the other sector will still be continuously counted as service in the cipher profession.- Individuals engaged in cipher work who are sent abroad as spouses of officials and public employees within the payroll of the agency or unit, and those receiving salaries as part of the armed forces, if sent to work, study abroad for 30 consecutive days or more.
