Duties and Rights of Persons with Disabilities Participating in Inclusive Education

Circular 03/2018/TT-BGDDT has been issued by the Ministry of Education and Training, replacing Decision 23/2006/QD-BGDDT which stipulates regulations on inclusive education for persons with disabilities.

According to Circular 03, in addition to performing their duties and exercising their rights, persons with disabilities participating in inclusive education shall undertake the following tasks:

Regarding Duties:

- Study and train according to the personal education plan for persons with disabilities.- Inform about their health status, learning ability, and propose support needs to their family and educational institution when necessary.- Respect officials, teachers, and staff within the educational institution; unite, assist, and support each other in learning and training; comply with school regulations; protect and maintain common property.

Regarding Rights:

- Persons with disabilities are allowed to enroll at an older age compared to the enrollment age as regulated;- Have the right to study in educational institutions suitable to their level and ability; receive care, respect, and protection, and be treated equally in learning and educational activities to develop personal abilities; receive information, textbooks, learning materials, and scholarships as regulated;- Persons with disabilities have the right to study, train, and receive support in individual lessons on specific knowledge and skills for effective inclusive learning;- Receive advice on support services, early intervention, inclusive education, and vocational orientation in line with their abilities and needs;- Have their disability status information kept confidential;- Be commended and rewarded for achievements in study and training;- Be entitled to policies regarding education for persons with disabilities.

Circular 03/2018/TT-BGDDT takes effect from March 16, 2018.
