Decree 24/2015/ND-CP stipulates detailed regulations and measures for the implementation of certain provisions of the Law on Inland Waterway Traffic and the Law on Amendments and Supplements to certain provisions of the Law on Inland Waterway Traffic issued on February 27, 2015.
Determining the Scope of Inland Waterway Navigation Corridor Protection (Illustrative Image)
Decree 24/2015/ND-CP stipulates the scope of the inland waterway navigation corridor protection as specified in Clause 4, Article 16 of the Law on Inland Waterway Transport, determined from the edge of the channel outward on each side according to the technical grade of the inland waterway. Specifically:
- Scope of the inland waterway navigation corridor protection in the case where the channel is not adjacent to the shore.
- For inland waterway channels in lakes, bays, river mouths to the sea, coastal areas, and special-grade channels: From 20 m to 25 m;- For inland waterway channels of Grade I, Grade II: From 15 m to 20 m;- For inland waterway channels of Grade III, Grade IV: From 10 m to 15 m;- For inland waterway channels of Grade V, Grade VI: 10 m.
- Scope of the inland waterway navigation corridor protection in the case where the channel is adjacent to the shore is calculated from the natural shore edge inward to the shore at least 5 m; in the case the channel is in an urban area, district-level town, or commune-level town, the scope of the corridor protection is the red-line boundary as approved by the competent authority following the planning.
Additionally, based on the characteristics of each area, the inland waterway management agency shall preside, cooperate with the Department of Natural Resources and Environment to specifically determine the natural shore edge to serve the protection of inland waterway infrastructure.
Simultaneously, the Decree also stipulates the scope of protection for inland waterway infrastructure components in the airspace and underground as specified in Clause 2, Article 14 of the Law on Inland Waterway Transport, according to the technical grade of each inland waterway, ensuring traffic safety, infrastructure safety, and non-interference with the management and maintenance of inland waterways.
