On July 28, 2017, the Supreme People's Court issued Circular 02/2017/TT-TANDTC to specifically stipulate the rules to be followed in the courtroom.
Circular 02 stipulates that the courtroom rules shall be implemented according to legal regulations and the following provisions:
- The Trial Panel, Procurators, Court Clerk, participants in the proceedings, and attendees of the trial must sit in the correct positions in the courtroom;- Judges, Jurors, and the Court Clerk must wear judicial attire in accordance with regulations;- The court is allowed to record audio, video, and audio-visual recordings of the trial proceedings pursuant to procedural law.
Additionally, Circular 02 stipulates that individuals who violate courtroom rules may, depending on the case, be ordered by the Chief Judge to leave the courtroom or the trial area, be administratively fined, or be administratively detained. If the violation of courtroom rules constitutes a criminal offense, the Trial Panel has the right to initiate a criminal case.
Attention is drawn to the fact that if Judges, Jurors, and the Court Clerk do not wear the appropriate judicial attire during a trial, they will be subject to disciplinary actions based on the nature and severity of the violation, as per the regulations on handling the responsibilities of judicial office holders in the People's Court or they may face disciplinary sanctions according to legal regulations.
Before opening the trial, the Court Clerk must ensure order, check the presence of those summoned by the court, disseminate the courtroom rules, and perform other procedures as required by procedural law.
