Conditions for the Operation of New Construction, Repair, and Restoration Facilities for Inland Waterway Vessels

Decree 24/2015/ND-CP stipulates detailed regulations and measures for the implementation of certain provisions of the Law on Inland Waterway Traffic and the Law on Amendments and Supplements to certain provisions of the Law on Inland Waterway Traffic issued on February 27, 2015.

Decree 24/2015/ND-CP stipulates that organizations and individuals engaged in the construction, conversion, repair, and rehabilitation of vessels (hereinafter referred to as new construction, repair facilities) specified in Clause 1, Article 27 of the Inland Waterway Transport Law must establish enterprises according to legal regulations, register the business sectors related to the construction and repair of inland waterway vessels, and ensure the following conditions:

1. Have appropriate physical facilities, equipment; and a suitable plan for production and business organization, matching the type and size of the vessels produced or the service provided.

2. Have a quality management and supervision department to ensure that products meet all standards and conditions regarding quality, technical safety, and environmental protection as stipulated.

3. Have technical personnel and a quality inspection department that meet the requirements for production and business operations. Specifically:

- For facilities constructing, converting, or repairing vessels with a capacity of 50 or more people; non-motorized vessels with a total weight of 200 tons or more; motorized vessels with a total main engine capacity of 135 horsepower or more; specialized vessels such as floating docks, floating terminals, floating construction equipment, floating houses, floating hotels, dredgers, suction boats, and other types of vessels with a designed length of 10 meters or more, there must be a technical section and a product quality inspection section, each with at least one engineer specialized in shipbuilding and one engineer specialized in marine engine.- For facilities constructing, converting, or repairing passenger-carrying vessels from 13 to under 50 people; motorized vessels with a total main engine capacity from 50 to under 135 horsepower; vessels with a designed length of 20 meters or more and a total weight under 200 tons; specialized vessels such as floating docks, floating terminals, floating construction equipment, floating houses, dredgers, suction boats, and other types of vessels with a designed length of less than 10 meters, each section needs at least one technical staff with a college degree or vocational training in shipbuilding and one technical staff with a college degree or vocational training in marine engine.- For facilities constructing, converting, or repairing vessels with a designed length of less than 20 meters; motorized vessels with a total main engine capacity of less than 50 horsepower; motorized vessels with a total main engine capacity up to 15 horsepower and a passenger capacity up to 12 people, there must be at least one worker specialized in shipbuilding.- For facilities constructing, converting, or repairing vessels made of wood according to traditional experience passed down through generations in a region and have been safely operated and certified (traditional vessels), with a designed length of less than 20 meters; motorized vessels with a total main engine capacity of less than 50 horsepower; cargo vessels with a total weight under 100 tons; passenger vessels with a capacity under 12 people, there must be at least one skilled worker.

4. Have a plan ensuring fire and explosion prevention, occupational safety, and hygiene, as well as an environmental pollution prevention plan approved by the competent authority according to regulations.
