On July 10, 2017, the Ministry of National Defense issued Circular 162/2017/TT-BQP detailing the conditions for retirement for professional military personnel.
Circular 162 stipulates that professional soldiers with decisions to cease active duty are entitled to retirement when they fall under one of the following cases:
- Eligible for retirement according to Article 8 Decree 33/2016/ND-CP detailing and guiding the implementation of certain articles of the Law on Social Insurance regarding compulsory social insurance for soldiers, public security officers, and cipher workers with salaries equivalent to soldiers;- Reaching the highest age limit for active duty of professional soldiers according to military rank as stipulated in Clause 2 Article 17 of the Law on Professional Soldiers, Defense Workers, and Public Employees and having at least 20 years of social insurance contributions;- Reaching 40 years old, having at least 20 years of social insurance contributions, of which at least 15 years were spent as combat officers stipulated in Circular 213/2016/TT-BQP that regulates the role of combat officers in the regular forces of the People's Army that the Army can no longer deploy or transfer to another sector.
Additionally, Circular 162 also stipulates that defense workers and public employees with a decision to cease serving in the Army are entitled to retirement when they fall under one of the following cases:
- Eligible according to Clause 1 Article 54, Clause 1 Article 55 of the 2014 Law on Social Insurance; Article 6 Decree 115/2015/ND-CP detailing certain articles of the Law on Social Insurance regarding compulsory social insurance;- Males reaching 50 years old, females reaching 45 years old, with at least 20 years of social insurance contributions, of which at least 15 years were spent as defense workers;- In case of not meeting eligibility requirements, due to organizational restructuring where the Army no longer requires deployment, if males are between 55 and 60 years old, females are between 50 and 55 years old, and they have at least 20 years of social insurance contributions, they are entitled to retirement.- Professional soldiers, defense workers, and public employees upon retirement, are entitled to social insurance benefits according to the 2014 Law on Social Insurance and documents detailing and guiding the implementation of certain articles of the Law on Social Insurance regarding compulsory social insurance.
