Conditions for Organizing the First Condominium General Assembly

The content is stipulated in Circular 02/2016/TT-BXD issued by the Ministry of Construction on February 15, 2016, promulgating regulations on the management and use of apartment buildings.

Accordingly, the conditions regarding the number of attendees at the initial condominium meeting are stipulated in Circular 02 as follows:

- For a meeting of an apartment building, at least 75% of the apartment owners who have taken possession must attend; in case the initial meeting is convened without 75% of the apartment owners attending, a second meeting is convened when at least 50% of the apartment owners who have taken possession attend. If the second meeting is convened and the required number of attendees is not met, the investor shall request the commune-level People's Committee (hereinafter referred to as the ward-level People's Committee) where the apartment building is located to organize the meeting as prescribed;- For a meeting of a condominium complex, there must be a sufficient number of people who have agreed to include the building in this condominium complex attending; in case the initial meeting is convened without the required number of attendees, a second meeting is convened when at least 50% of the people who agreed to include the building in the condominium complex attend; if the second meeting is convened without the required number of attendees, it is proposed that the ward-level People's Committee organize the meeting as prescribed, except in the case of establishing a separate building management board;- In case a building in the complex does not have enough attendees for the complex meeting after the second convening, the owners of that building can organize a condominium meeting to establish a separate building management board as prescribed.
