Decree No. 128/2018/ND-CP amending and supplementing the Decree stipulating the conditions for investment and business in the inland waterway sector was issued on September 24, 2018. Notably, the amendments include changes to the business conditions for establishments that construct new, convert, and repair and restore inland waterway vehicles.
To be specific:
According to Clause 1, Article 3 of Decree 128/2018/ND-CP, amending and supplementing Article 6 of Decree 24/2015/ND-CP, the business conditions for facilities engaged in the construction, conversion, repair, and restoration of inland waterway means include:
Facilities engaged in the construction, conversion, repair, and restoration of inland waterway means must establish a business or cooperative in accordance with Vietnamese law.
Have physical facilities, equipment, technological processes, and construction capabilities suitable for the types and sizes of inland waterway means produced and serviced, in accordance with the national technical regulations issued by the Minister of Transport.
Have personnel that meet production and business operational requirements. To be specific:- For facilities engaged in the construction, conversion, repair, and restoration of means that carry 50 or more people; non-motorized means with a total load of 200 tons or more; motorized means with a total main engine power of 135 horsepower or more; specialized means such as floating docks, floating stations, floating construction equipment, floating houses, floating hotels, dredgers, suction boats, and other inland waterway means with a design length of 10 meters or more, there must be at least 01 person with a university degree in shipbuilding and 01 engineer specialized in marine engineering.- For facilities engaged in the construction, conversion, repair, and restoration of inland waterway means that carry from 13 to under 50 people; motorized means with total main engine power from 50 to under 135 horsepower; means with a design length of 20 meters or more and a total load under 200 tons; specialized inland waterway means such as floating docks, floating stations, floating construction equipment, floating houses, dredgers, suction boats, and other means with a design length of less than 10 meters, each part must have at least 01 person with an intermediate degree in shipbuilding or a vocational college degree in shipbuilding and 01 person with an intermediate degree in marine engineering or a vocational college degree in marine engineering.- For facilities engaged in the construction, conversion, repair, and restoration of means with a design length of less than 20 meters; motorized means with total main engine power under 50 horsepower; motorized means with total main engine power up to 15 horsepower and carrying up to 12 people, there must be at least 01 person with a primary certificate in ship hull construction technology.- For facilities engaged in the construction, conversion, repair, and restoration of wooden means built according to traditional experience handed down through generations in each region and operating safely as recognized by registry offices (folk means), including means with a design length of less than 20 meters; motorized means with total main engine power under 50 horsepower; freight means with a total load under 100 tons; means carrying under 12 people, there must be at least 01 skilled worker experienced in the construction, conversion, repair, and restoration of wooden inland waterway means.
