The Ministry of Health issued Circular 45/2017/TT-BYT on November 16, 2017, stipulating in detail the authorities competent to establish the ethics committee for biological research.

Circular 45 stipulates that the following authorities have the jurisdiction to establish an Ethics Council:

- The Minister of Health establishes the National Ethics Council in biomedical research and approves its operating regulations, appoints, dismisses, removes, or supplements and replaces members of the National Ethics Council.- Organizations with the authority to approve research establish the Local Ethics Council in biomedical research. The head of the organization that establishes the Local Ethics Council approves the organization and operation regulations of their Ethics Council and decides on the appointment, dismissal, removal, or supplementation and replacement of members of the Ethics Council.- For organizations that do not qualify to establish an Ethics Council, the review and evaluation of biomedical research involving humans are conducted by an Ethics Council established by the Department of Health or by an Ethics Council with appropriate expertise.
