Recently, there have been many land subsidence cases, especially in the southern provinces. Therefore, to minimize this situation, the Government issued Decree No. 167/2018/NĐ-CP on restriction on groundwater extraction.
According to Decree No. 167/2018/NĐ-CP of Vietnam’s Government, areas where groundwater extraction is restricted shall be categorized as follows:
- Restricted area 1 shall include the zones mentioned in points c and d, clause 4, Article 52 of the Law on water resources 2012 of Vietnam and shall be delineated in accordance with the regulations of Article 6 of Decree No. 167/2018/NĐ-CP of Vietnam’s Government.
- Restricted area 2 shall include the zones mentioned in Clause 4b, Article 52 of the Law on water resources 2012 of Vietnam and shall be delineated in accordance with the regulations of Article 7 of Decree No. 167/2018/NĐ-CP of Vietnam’s Government.
- Restricted area 3 shall include the zones mentioned in Clause 4dd, Article 52 of the Law on water resources 2012 of Vietnam and shall be delineated in accordance with the regulations of Article 8 hereof.
- Restricted area 4 shall include the zones mentioned in clause 4a, Article 52 of the Law on water resources 2012 of Vietnam and shall be delineated in accordance with the regulations of Article 9 of Decree No. 167/2018/NĐ-CP of Vietnam’s Government.
- In case where the restricted areas mentioned in points a, b, c, and d of this clause include restricted zones which overlap each other, the overlap area shall be categorized as a mixed-restriction area.
