Amendment of the Application for the Issuance of a Permit for the Transportation of Dangerous Goods

Circular 09/2018/TT-BKHCN amending a number of articles of Circular 09/2016/TT-BKHCN was issued on July 1, 2018. This Circular has amended the dossier components required for applying for a Dangerous Goods Transport Permit.

To be specific, according to Article 1 of Circular 09/2018/TT-BKHCN amending certain provisions of Circular 09/2016/TT-BKHCN, the dossier for the application for a Dangerous Goods Transport License includes:

- Application form for Dangerous Goods Transport License;- Certificate of the organization or individual permitted to engage in the business of dangerous goods or permitted to conduct business in the transport of goods in accordance with current legal regulations;- Declaration form with details of the dangerous goods;- Valid vehicle operator's license consistent with the type of vehicle used for transporting dangerous goods;- Vehicle registration certificate, safety technical inspection certificate, and environmental protection certificate of the vehicle, all valid, issued by the competent authority;- Valid compulsory civil liability insurance certificate for the vehicle owner, issued by the insurance agency.

In case the organization or individual possessing dangerous goods needs to hire a transport vehicle, the organization or individual must submit a copy of the commercial contract or agreement on the transport of dangerous goods, signed and sealed (if applicable) by the parties, detailing information about the transport vehicle (type, registration number, load capacity);

- Valid labor safety - occupational hygiene training certificate for those involved in the transport of dangerous goods issued under Circular 27/2013/TT-BLDTBXH;- Certificate of participation in and completion of chemical safety technical training program, valid, issued by the Department of Industry and Trade to the vehicle operator, escort, and those involved in the transport of dangerous goods;- Safety data sheet for the dangerous goods to be transported in Vietnamese, provided by the manufacturing or importing enterprise as specified in Clause 3 Article 29 of the Chemical Law, along with a copy of the original language version from the manufacturing enterprise (if available). The content of the Safety Data Sheet should comply with Circular 28/2010/TT-BCT;- Emergency response plan for chemical incidents during the transportation of dangerous goods approved by the competent authority as per Article 9 of Circular 44/2012/TT-BCT for goods requiring such a plan;- Equipment cleaning plan and implementation of environmental protection requirements after the transportation of dangerous goods, signed and sealed by the organization or individual applying for the Dangerous Goods Transport License as specified in Form 3. PALSTB Appendix issued with Circular 09/2018/TT-BKHCN.

If the organization or individual applying for the Dangerous Goods Transport License involves multiple vehicle operators, multiple vehicles, multiple escorts, or various types of dangerous goods, they must provide all relevant documents according to Points d, dd, e, g, h, i, k Clause 1 Article 4 of Circular 09/2016/TT-BKHCN for each additional case (for goods requiring an emergency response plan).
