Recently, the Government of Vietnam has just signed and promulgated Decree 36/2013/ND-CP regarding job positions and the grading structure of officials.
Adjustments to job positions and the structure of official ranks in agencies, organizations, and units are carried out in cases specified in Clause 1, Article 12 of Decree 36/2013/ND-CP as follows:

- Agencies, organizations, and units have their functions, tasks, powers, and organizational structure supplemented or adjusted as decided by the competent authority;- Agencies, organizations, and units are reorganized or dissolved as decided by the competent authority;- Establishment of new, merger, split, or adjustment of provincial and district administrative boundaries; socio-economic development situation, economic structural shift, application of science and technology, urbanization, and security order;- The nature, characteristics, requirements, complexity, scale of work, management scope, service targets, specialized management processes of the agency, organization, or unit change as decided by the competent authority;- Equipment, working facilities, the degree of office modernization, information technology application of the agency, organization, or unit change as decided by the competent authority.
The sequence and procedures for adjusting job positions and the structure of official ranks in agencies, organizations, and units are carried out according to the sequence and procedures for determining job positions and the structure of official ranks stipulated in Decree 36.
For agencies, organizations, and units newly established according to the decision of the competent authority, the list of job positions and the structure of official ranks must be determined from the stage of preparing the establishment project and approved by the competent authority in the Establishment Decision.
