Acts of misconduct or corruption in cadre work in Vietnam are specified in Chapter II of Regulation 114-QD/TW in 2023, including:
(1) Acts of abusing positions and powers
- Using the prestige and influence of oneself and those with family relationships to suggest, influence, and pressure others to decide, direct, advise, propose, comment, evaluate, vote, take a vote of confidence, vote to introduce personnel, and vote at will.
- Allowing people with family relationships or close relationships to take advantage of their positions, powers, and reputations to influence, manipulate, and interfere in all stages of cadre work.
- Incorporating personal intentions when performing stages in cadre work for motivation, self-seeking purposes, or benefits for personnel in the process of performing cadre work.
- Directing and advising the stages in staff work as prescribed in Clause 1, Article 2 of this Regulation for personnel who do not meet the conditions and standards; not in accordance with principles, regulations, processes, regulations, and decisions.
- Postponing, not implementing when it is unfavorable, or choosing a favorable time for personnel at their discretion to carry out the staffing process.
- When receiving a complaint or letter of complaint or denunciation, or knowing that an employee has engaged in corrupt or negative behavior in staff work, but compromises, tolerates, covers up, does not handle it according to its competence, does not handle it according to regulations, or does not report it to the competent authority for handling.
- Confirming, certifying, commenting, and evaluating are impositional, not true in nature, not true or forged, and involve falsifying the contents of personnel records, election results, recommendation cards, votes of confidence, recruitment, and selection examinations for the benefit of personnel or for personal purposes.
- Providing or disclosing information, documents, and records of officials and party members to organizations and individuals without authority and responsibility, especially information, documents, and personnel records that are in the process of implementing the cadre work process.
(2) Acts of bribing one's way up
- Directly or indirectly brokering, giving, and receiving bribes in order to help others obtain positions and interests.
- Giving gifts, money, real estate, or other material and immaterial benefits, arranging entertainment and entertainment activities for competent and responsible people for the purpose of gaining support, trust, position, and interests.
- Running age, working seniority, emulation titles, rewards, degrees, assignment, appointment, nomination, nomination, mobilization, rotation, secondment, promotion, promotion... for the purpose of meeting the criteria, conditions, and obtaining positions and benefits.
- Taking advantage of familiar relationships or using the advantages, working positions, and reputations of others to influence, enlist, and pressure people with authority and responsibility for the purpose of obtaining positions and interests.
- Taking advantage of the knowledge of inside information or unfavorable information of organizations and individuals to place conditions and put pressure on competent and responsible persons in assigning, appointing, introducing, nominating, and appointing themselves.
- Using his/her background, family background, and work achievements to make unreasonable demands on competent and responsible organizations and individuals in order to obtain positions and interests.
(3) Other acts of misconduct
- Meeting, contacting, and exchanging with employees in contravention of regulations during the performance of staff work. Disturbing, causing difficulties, troubles, prolonging time, setting conditions for personnel, and agencies submitting personnel.
- Lack of responsibility or personal motives to lose records of officials under their management.
- Forging, falsifying records and documents to be considered and implemented in regulations, processes, regulations, and decisions on personnel work.
- Reporting, making records, and declaring the background of party members, cadres, especially personal and family history, is incomplete and dishonest.
- Directly, through other people, taking advantage of the mass media and social networks to post untrue information, distort, incite, cause internal disunity, and adversely affect cadres' work.
