6 Types of Documents That Cannot Be Authenticated as Copies

According to Decree 23/2015/ND-CP, not every case will authorities certify copies from the original documents for the requester. Currently, there are 06 cases where the original documents cannot be used as a basis for certifying copies.

To be specific: the following cases:

  1. The original document has been erased, altered, added to, or subtracted from in an invalid manner;
  2. The original document is damaged, decayed, and its content cannot be determined;
  3. The original document carries the confidential seal of a competent authority or organization, or does not carry a confidential seal but clearly states it cannot be copied;
  4. The original document contains content that is against the law and social ethics; promotes or incites war against the socialist policies of Vietnam; distorts the history of the Vietnamese nation; insults the honor, dignity, and reputation of individuals and organizations; violates citizen rights;
  5. The original document is issued, notarized, or certified by a competent foreign authority and has not been legalized;
  6. Papers and documents are self-created by individuals without confirmation and seal from a competent authority or organization.

In addition to the aforementioned cases, the original documents issued by competent authorities and self-created documents with confirmation and seal from competent authorities or organizations may be presented to request for authentication. The authentication authority is carried out as prescribed in Article 5 of Decree 23/2015/ND-CP and detailed guidance in Section 1 of Official Dispatch 1352/HTQTCT-CT.

Authentication must be performed immediately on the day the request is received or on the next working day if the request is received after 3:00 PM.
